RECOMMENDED MOTION:
Move the board approve an Interlocal Agreement between the EAA and New Braunfels Utilities for the operation of a water level observation well at Comal Plant No.3 (DX-68-23-304), adjacent to Comal Springs, New Braunfels, Texas for the period May 1, 2024, through May 31, 2034.
SUMMARY:
The purpose of this agenda item is for the board to consider a Research & Technology Committee recommendation to approve an Interlocal Agreement between the EAA and New Braunfels Utilities (NBU). A summary of the agreement is presented below.
Background:
The agreement serves as an ongoing access agreement for the EAA to use an NBU-owned well, DX-68-23-304, commonly known as the “LCRA” well, near Comal Springs for Edwards Aquifer and spring monitoring purposes. The EAA has worked with NBU since 2000 to evaluate flowpaths in the vicinity of Comal Springs and to monitor water levels and water quality in the Aquifer. This agreement seeks to continue this collaboration.
Authorized Activities:
The complete list of authorized monitoring activities can be found in section 8 of the contract, some of which include:
· Water quality sampling
· Geophysical logging
· Continuous water level monitoring
· Assessment of discharge of Comal Springs and the water level in the well.
Any data collected from the well will be provided to NBU upon request. The agreement would allow for continual EAA access to the LCRA well for the 10-year agreement period.
Attached to this summary is the agreement, which has been reviewed by legal counsel.
