Receive report from EAA staff on revisions to the EAA Compliance Settlement Guidelines.

STAFF RECOMMENDED MOTION:

 

None.  This item is for informational purposes only.

 

 

SUMMARY:

 

The purpose of this agenda item is for the Permits/Enforcement Committee to receive a report from EAA staff on revisions to the EAA’s General Manager Compliance and Settlement Guidelines (“guidelines”) as they relate to Chapter 711 (Groundwater Withdrawals) of the EAA’s rules, and more specifically, to the issue of water waste from flowing abandoned Edwards Aquifer wells.  These revisions, which are attached to this item, reflect staff's compliance approach as evidenced by the board's recent approval of the William J. Bordelon VFW Post 4700 Compromise and Settlement Agreement (CSA).

 

Following this report and with the concurrence of the committee, staff will begin following Compliance Settlement Guidelines, as revised.  At the August 27 Permits/Enforcement Committee meeting, staff will discuss these recommended revisions and answer questions accordingly.

FISCAL IMPACT:

 

Revenue received through compliance settlements is dedicated to the Endangered Species Mitigation Fund.  This revenue is used solely to fund projects expressly devoted to the protection and benefit of the endangered species associated with the Edwards Aquifer.   No revenue derived from compliance settlements is used to fund the operating expenses or capital purchases of the EAA.
