RECOMMENDED MOTION:

Move the board authorize the General Manager to enter into a Compromise and Settlement Agreement regarding the pending enforcement matter with the William J. Bordelon VFW Post 4700.

SUMMARY:

The purpose of this agenda item is for the board to consider a Permits/Enforcement Committee recommendation to authorize the General Manager to enter into a Compromise and Settlement Agreement (CSA) regarding alleged violations of EAA Rules as described below.

William J. Bordelon Post 4700 Veterans of Foreign Wars of the United States

The William J. Bordelon Post 4700 Veterans of Foreign Wars of the United States (Post or Owner) is currently in alleged violation of EAA rule related to uncontrolled artesian flow (non-beneficial use) and making unmetered withdrawals from the aquifer, related to an Edwards Aquifer well located at 2219 Frio City Road in San Antonio, Texas. EAA staff believes that a valve or cap at the well head is either damaged or deteriorated and with high current aquifer levels, groundwater is flowing under artesian pressure uncontrolled from the well. This flow has temporarily been diverted to a storm sewer line to stop the surface runoff.

On or about January 17, 2019, San Antonio Water System (SAWS) staff alerted the EAA to a possible leaking Edwards Aquifer well, identified as W104-110 in EAA records. SAWS staff reported citizen complaints of water waste, and an investigation showed that the well was leaking due to the currently high water levels in the Edwards Aquifer. The estimated land surface elevation of the well is 672.7 feet mean seal level (msl). The level of Index Well J-17 on that date reached a daily high of 686.7 feet msl.
