Move the board accept the counter-offer presented below and allow the well W107-002, owned by Broderick E. and Susan G. Milford dba Fey's Boat and Camper Storage to maintain Limited Production Well status.


SUMMARY:

The purpose of this agenda item is for the board to consider a Permits/Enforcement Committee recommendation to consider a counter-offer from Broderick E. and Susan G. Milford dba Fey's Boat and Camper Storage (“the Owner”) of a limited production well (LPW) W107-002, that has been unable to maintain annual groundwater withdrawal limits for the well. The Owner claims that nearby road construction in 2018 damaged a second well they own, and were required to rely only on the LPW to supply needed water, and this caused the overpumping. Also, subsequent repair and redistribution from a second nearby well, which will also be a registered LPW, should permanently resolve future non-compliance from the overpumped LPW.

Broderick E. and Susan G. Milford dba Fey's Boat and Camper Storage filed a LPW registration with the EAA on December 31, 2015. EAA records indicate the owner reported metered withdrawals in 2015, 2016, 2017 and 2018 of 2.954, 1.498, 1.152, and 2.637 acre-feet, respectively. Following the occurrences in 2015 and 2016, EAA staff notified the owner that continued over-pumping of the LPW annual limit may result in loss of LPW status. EAA recognizes a downward pumping trend, and that the well was not overpumped in 2017.
