STAFF RECOMMENDED MOTION:

The committee may recommend the board accept or reject the counter-offers as proposed or modified regarding the pending enforcement matters presented below.

Move that the Permits/Enforcement Committee accept/reject the settlement counter-offers as proposed from San Marcos Baptist Academy; San Antonio Zoo; and 4-D Water Company LLC, related to exceeding authorized groundwater withdrawals during 2023.


SUMMARY:

The purpose of this agenda item is for the Permits/Enforcement Committee to consider counter-offers from the permit holders listed below in response to EAA settlement offers to resolve ongoing enforcement matters related to exceeding 2023 annual authorized withdrawal amounts. These enforcement matters and proposed counter-offers received from the permit holders are summarized herein for committee consideration. If in the course of discussion, the committee determines the need to do so, it may enter into closed session to consult with General Counsel on these matters.

San Marcos Baptist Academy
San Marcos Baptist Academy was identified as exceeding annual authorized industrial groundwater withdrawal amounts during 2023 on Permit P100-825. This entity was permitted to withdraw 40.026 acre-feet; however, required CPM withdrawal interruptions established their annual authorized groundwater withdrawal amount at 25.693 acre-feet. San Marcos Baptist Academy reported a total of 33.774 acre-feet withdrawn; thus exceeding their annual authorized amount by 8.081 acre-feet. The settlement offered for this alleged violation is $2,194.96, consistent with the EAA settlement guidelines.
