Consider recommendation from EAA staff calling for the election of nine voting members to the EAA Board of Directors from nine single-member districts within the boundaries of the EAA to be held on November 3, 2026.

STAFF RECOMMENDED MOTION:

 

Move the board adopt Resolution and Order No. 07-26-151 of the Edwards Aquifer Authority Board of Directors calling for the election of nine voting members to the EAA Board of Directors from nine single-member districts within the boundaries of the EAA to be held on November 3, 2026, and providing for matters related to the holding of said election in accordance with applicable law.

 

 

SUMMARY:

 

The purpose of this item is to seek adoption of a resolution and order calling for the election of nine voting members to the Board of Directors ("Board") of the Edwards Aquifer Authority ("EAA") as required by the Edwards Aquifer Authority Act ("Act").  Section 1.09(b) of the Act states, "The board [of the EAA] shall order elections of the appropriate number of directors to replace directors holding elected offices whose terms are nearest expiration to be held on the uniform election date in November of each even-numbered year."

 

The EAA must order its election no later than the 78th day before the election day, which is August 17, 2026.  Tex. Elec. Code § 3.005(c)(1).  The terms of the current odd-numbered district directors expire on December 1, 2026, see Act § 1.09(a). In addition, the director currently representing District 8 was appointed by the board at the March 2026 meeting to fill an unexpired term, see Act § 1.09(c).  The EAA is required to call for an election to be held on November 3, 2026 (the uniform election date), to elect a director to those certain seats that are up for election in 2026. Accordingly, the EAA is required to hold an election on November 3, 2026, for the following director positions:

 

District 1 - Bexar                                                               (4-year term)

District 3 - Bexar                                                               (4-year term)

District 5 - Bexar                                                                (4-year term)

District 7 - Bexar                                                                (4-year term)

District 8 - Comal                                                                (2-year term)

District 9 - Comal & Guadalupe                      (4-year term)

District 11 - Hays & Caldwell                     (4-year term)

District 13 - Medina & Atascosa                      (4-year term)

District 15 - Uvalde                                                                (4-year term)

 

EAA staff has contacted election officials in Bexar, Comal, Guadalupe, Hays, Caldwell, Medina, Atascosa, and Uvalde Counties about entering into contracts whereby the county election officials for those counties will administer the EAA's election in their respective counties.

 

Attached to this summary is a copy of Resolution and Order No. 07-26-151 calling for the elections.
