MOTION:

 

Move the board approve a Final Order Partially Approving the Notice of Claim to Interest by Sharon Eisenhauer relative to Initial Regular Permit No. P100-175 (BE00067) and authorize the General Manager to take all actions necessary to amend the affected permit and issue regular permits accordingly.

 

 

SUMMARY:

 

The purpose of this agenda item is to seek a recommendation from EAA staff to the board to partially approve Sharon Eisenhauer’s claim to an interest in Initial Regular Permit P100-175 (BE00067) and to authorize the General Manager to take all necessary actions required to amend the affected permit (Roger Verstuyft, Marvin Verstuyft, Sharon Eisenhauer, Margaret Verstuyft, Cyril Verstuyft Estate) and issue Regular Permits to the parties of interest.

 

On February 26, 2025, Sharon Eisenhauer submitted a Notice of Claim to Interest (Notice) in 26.630 acre-feet of Unrestricted Irrigation Groundwater rights (UIG) associated with Initial Regular Permit (IRP) No. P100-175 (BE00067). This claim asserts that the Claimant owns a proportionate share of 133.200 UIG in the amount of 26.630 acre-feet.

 

EAA staff has reviewed the deeds relevant to historical conveyances of interests in ownership in Edwards Aquifer IRP No. P100-175 (BE00067). After consultation with General Counsel, EAA staff recommends the partial approval of the Notice of Claim, pursuant to the finding of facts.  Based on the information submitted by the Claimant regarding EAA Groundwater Rights ownership, information contained within the EAA’s permitting files, and Bexar County Deed Records, the EAA finds that the 133.200 UIG shall be partitioned and permitted to all parties of interest.  Specifically, staff recommends that the UIG be partitioned as follows:
